Question about what the law says about Prostitution?

I'm watching a show on Tru T.V and they are doing undercover prostitution stings. All of the men that took the "Bait" said they would pay a certain amount for the service but never acted on it and drove away. They were all arrested. Is it illegal to say that you will pay for and not act on it?
